Koda ISPS

Pada tanggal 12 Desember 2002, IMO telah menyetujui amandemen SOLAS dalam meningkatkan sistem keamanan kapal dan fasilitas pelabuhan. Amandemen tersebut adalah Chapter baru dari SOLAS yaitu XI-2 “Special Measure to Enhance Maritime Security”. IMO juga menyetujui pemberlakuan International Ship Security and Port Facility Code (ISPS Code). Pemenuhan Part A dari ISPS Code adalah mandatory bagi kapal-kapal yang terkena lingkup penerapan serta fasilitas pelabuhan yang melayani jasa kepelabuhan terhadap kapal`yang beroperasi secara internasional.

Tujuan dari ISPS Code adalah:

● Membentuk kerangka kerjasama internasional antar negara-negara anggota (Contracting Government), Badan-badan pemerintah, Pemerintah setempat, Industri Pelayaran dan Pelabuhan untuk mendeteksi ancaman keamanan dan mencegah insiden keamanan yang berpengaruh terhadap kapal-kapal atau fasilitas pelabuhan yang dipergunakan untuk perdagangan internasional.
● Menetapkan peran dan tanggung jawab setiap negara anggota (Contracting Government), Badan-badan pemerintah, Pemerintah setempat, Industri Pelayaran dan Pelabuhan, baik ditingkat nasional maupun internasional untuk menjamin keamanan di laut (maritim).
● Menjamin pengumpulan dan saling tukar informasi keamanan yang dini dan efisien.
● Menyediakan suatu metodologi untuk penilaian keamanan yang dipergunakan untuk membuat rencana keamanan dan prosedur-prosedur untuk tindakan aksi terhadap perubahan setiap level keamanan; dan
● Menjamin kepercayaan diri bahwa tindakan keamanan maritim telah mencukupi dan sesuai dengan proporsinya.

ISPS Code ini diberlakukan secara internasional mulai 1 Juli 2004, untuk:

● Tipe-tipe kapal yang melayari perairan internasional, meliputi Kapal Penumpang, termasuk High Speed Passenger Craft, Cargo Ship, termasuk High Speed Craft dengan tonase > 500 GT dan Mobile Offshore Drilling Unit (MODU).
● Fasilitas Pelabuhan yang memberi layanan terhadap kapal-kapal yang melayari perairan internasional.

Sesuai dengan persyaratan ISPS Code, semua kapal yang terkena peraturan ini, harus menetapkan Sistem Manajemen Keamanan kapal yang didokumentasikan dalam manual Ship Security Plan (SSP) dalam rangka menjamin operasional kapal dengan aman. Persyaratan tersebut, meliputi mendokumentasikan Ship Security Assessment (SSA) & Ship Security Plan (SSP), menerapkan dan mempertahankan Sistem Manajemen Keamanan yang pada akhirnya akan diverifikasi oleh Pemerintah atau organisasi yang diakui (Recognized Security Organization / RSO) dalam rangka penerbitan sertifikat International Ship Security Certificate (ISSC) setelah dipenuhinya semua persyaratan ISPS Code. Masa berlakunya sertifikat ISSC adalah 5 tahun. Kapal yang tidak dapat memenuhi persyaratan ISPS Code akan menghadapi kesulitan dalam operasionalnya, khususnya diperairan internasional.

BKI sebagai Organisasi keamanan yang diakui (RSO) oleh Pemerintah Indonesia telah ditunjuk atas nama Pemerintah untuk melaksanakan approval, verifikasi dan menerbitkan sertifikat ISSC Interim atau short term. Sedangkan sertifikat ISSC permanen akan diterbitkan oleh Pemerintah cq Ditjen Perhubungan Laut. Data perusahaan dan kapal yang telah disertifikasi akan didaftarkan dan dipublikasikan dalam Buku Register ISPS Code oleh BKI.

Prosedur untuk mendapatkan sertifikat ISSC – ISPS Code sebagai berikut:

● Perusahaan pemohon menyerahkan form aplikasi dengan dilampirkan manual Ship Security Plan (SSP), Ship Security Assessement (SSA) dan salinan sertifikat Company Security Officer (CSO) / Ship Security Officer (SSO) kepada BKI Kantor Pusat cq Divisi Statutoria atau Kantor Cabang BKI terdekat.
● BKI akan melakukan approval atas manual SSP. Apabila ada kekurangan, maka manual akan dikembalikan untuk diperbaiki.
● Apabila manual SSP telah memenuhi syarat, BKI akan memberikan Laporan Kesesuaian Dokumen SSP dan memberikan stempel ‘Approval’ pada halaman depan dan setiap halaman dari manual SSP.
● Manual SSP yang sudah disetujui dikembalikan ke pemohon untuk diteruskan ke kapal ybs dalam rangka implementasi diatas kapa
● Setelah diimplementasikan minimal 3 bulan, Perusahaaan pemohon mengajukan aplikasi untuk dilakukan Verifikasi Awal (Initial Verification) diatas kapal untuk diperiksa kesesuaian antara manual SSP dengan penerapannya. Untuk ini, BKI akan mengirimkan auditor yang kompeten dalam memeriksa penerapan Sistem Manajemen Keamanan di atas kapal
● Jika memenuhi syarat, maka BKI akan menerbitkan Laporan Verifikasi Awal (Initial Verification Report) dan Sertifikat ISSC sementara (short term) yang berlaku 5 bulan.
● Untuk penerbitan ISSC permanen dari Pemerintah, BKI akan mengurus penerbitannya setelah semua ketidak-sesuaian yang ditemukan saat verifikasi sudah diperbaiki dan dilaporkan ke BKI.

Setelah mendapatkan sertifikat ISSC, maka ada kewajiban dari Perusahaan dan kapalnya untuk mempertahankan sertifikat tersebut dengan mengajukan permohonan verifikasi periodik dengan jadwal sebagai berikut:

● Verifikasi Antara (Intermediate Verification), dengan masa pengajuan antara tahun ke 2 hingga tahun ke 3 dari ulang tahun sertifikat.
● Verifikasi Pembaruan (Renewal Verification), pada tahun ke 5 dengan masa pengajuan 6 bulan sebelum habisnya masa berlaku sertifikat.

Selain itu, BKI diberi otorisasi untuk menerbitkan sertifikat ISSC Interim yang ditujukan bagi kapal dengan kondisi sebagai berikut:

● Kapal yang belum memiliki sertifikat ISSC.
● Kapal ganti perusahaan induknya, yang sebelumnya belum mengoperasikan kapal tersebut.
● Kapal baru berganti bendera kapal.

Persyaratan untuk mendapatkan ISSC Interim adalah:

● Ship Security Assessment (SSA) telah dilakukan dan didokumentasikan untuk kapal yang bersangkutan.
● Ship Security Plan (SSP) telah disusun, telah disetujui oleh Pemerintah /RSO yang ditunjuk dan siap / sedang diimplementasikan.
● Kapal dilengkapi dengan Ship Security Alert System (SSAS) sesuai dengan pemberlakuannya.
● Company Security Officer (CSO) menjamin SSP diterapkan diatas kapal, termasuk pelaksanaan security drill, pelatihan dan internal audit.
● Merencanakan waktu pelaksanaan Verifikasi Awal (Initial Verification).
● Nakhoda dan awak kapalnya mengetahui tugas dan tanggung jawabnya dalam hal keamanan kapal.
● Ship Security Officer (SSO) sesuai dengan persyaratan ISPS Code.

Masa berlaku ISSC Interim adalah 6 bulan dan tidak dapat diperpanjang.

 

ISPS Code

On December 12, 2002, IMO approved to SOLAS amandement to enhance ship security system and port facilities. The amandement is a new chapter of SOLAS XI-2 “Special Measure to Enhance Maritime Security”. IMO also approves application of International Ship Security and Port Facility Code (ISPS Code). Fulfillment part A from ISPS Code is mandatory for ship categorized into application scope as well as port facility serving port service to ship operating Internationally.

The objectives of ISPS Code are:

● The establish international coorperation framework among Contracting Government, government bodies, local government, Shipping industry and port to detect threat security and prevent security incident affecting to ship or port facility used for international trade.
● To outline the role and responsibility each Contracting Government, government bodies, local government, Shipping industry and Port, both national and international level to secure maritime security.
● To secure gathering and exchange of warn and efficient information security.
● To provide a methodology evaluate for security used to make security plan and procedures for action against change in every level security; and
● To secure self-confidence that maritime security act has been adequate and according to its proportion.

ISPS Code is adopted internationally as of 1 july 2004 for :

● Type of ships engaged international voyage, include passenger ship, including high speed passenger crafts, Cargo Ships including High Speed Crafts 500 GT and above and Mobile Offshore Drilling Unit (MODU).
● Port facility serving for ships engaged international voyage.

According with ISPS Code requirement, All ships subjected to this regulation shall establish Ship Security Management System already documented in manual Ship Security Plan (SSP) to ensure secure operation of the ship. Such requirement cover documenting Ship Security Assessment (SSA) & Ship Security Plan, Applying and maintaining the Secure Management System that will eventually verified by Government or a Recognized Organization (Recognized Security Organization / RSO) for issuance International Ship Security Certificate (ISSC) after the fulfillment of all requirement of ISPS Code. ISPS Code Certificate validity period is five years. Ship failing fulfill with requirement of ISPS Code will have difficulty in their operation, especially international waters.

BKI as Recognized Security Organization (RSO) in the Indonesia Government has been appointed on behalf the government to implement approval, verification and issuing the interim/short term ISSC. While, permanent ISSC certificate will be issued by Government through Directorat General of Sea Transportation. Data on the company and ships already certified will be registered and published in the Register Book ISPS Code by BKI.

The procedure for obtaining certificate ISSC-ISPS Code is as follows:

● Applicant submits an application form with attached manual Ship Security Plan (SSP), Ship Security Assessment ((SSA) and a copy Company Security Officer (CSO) / Ship Security Officer (SSO) certificate to BKI head office through Statutory Division or the nearst BKI branch office.
● BKI give its to approval on SSP manual. If there is insufficiency , manual will be return for corection.
● If there SSP manual has been eligible, BKI will issue report SSP Conformance Documentand give it the stamp “Approval” on the front page and every page on SSP manual.
● SSP manual that has been approved is returned to applicant to the ship in order to implement on board.
● After being implemented for minimum three months, carried on Company submitted an application for initial verification on board to examine the fit between SSP manual implementation. To this end, BKI will assign competent auditor to verify Security Management System on board.
● If eligible, BKI will issue Initial Verification Report and ISSC interm/short term which is valid for 5 months
● For the issuance permanent ISSC government, BKI will take care of publishing after all discrepancies found during verification which has been repaired and reported to BKI.

After obtaining certificate ISSC, then the company and its ship shall maintain such certificate by submitting application for periodical verification with the following schedule:

● Intermediate Verification with period between the submission of year two to years three of the certificate anniversary.
● Renewal Verification in the years five to six month prior to submission of expiration of the certificate.

In addition, BKI is authorized to issue ISSC certificate interim is intended for ships with the following condition:

● Ship that do not yet ISSC certificate.
● Ship replace parent company, which previously had not operate the ship.
● Ships change flag ship.

Requirement to obtain interim ISSC is:

● Ship Security Assessment (SSA) has been performed documented for the relevant ship.
● Ship Security Plan (SSP) has been prepared and approved by government / RSO appointed and being implemented.
● The ship equipped with Ship Security Alert System (SSAS) accordance with its application.
● Company Security Officer (CSO) to ensure SSP is applied on board, including the implementation of the security drill, training and internal audits.
● Initial Verification plan implementation time.
● The master and crew know their duties and responsibilities in term of ship security.
● Ship Security Officer (SSO) in accordance with the requirement of the ISPS Code.

Interim ISSC valid period is six month and can not be extended.

 

Koda ISM

A. Pengenalan

Sesuai dengan kesadaran terhadap pentingnya faktor manusia dan perlunya peningkatan manajemen operasional kapal dalam mencegah terjadinya kecelakaan terhadap kapal, manusia, kargo dan harta benda serta mencegah terjadinya pencemaran lingkungan laut, maka IMO mengeluarkan peraturan tentang manajemen keselamatan kapal & perlindungan lingkungan laut atau lebih dikenal dengan Koda International Safety Management (ISM Code) yang juga dikonsolidasikan dalam Konvensi SOLAS.

B. Pelayanan BKI

Sesuai dengan persyaratan ISM Code, semua perusahaan yang memiliki atau mengoperasikan kapal harus menetapkan Sistem Manajemen Keselamatan untuk perusahaan dan kapalnya dalam rangka menjamin operasional kapal dengan aman. Persyaratan tersebut, meliputi tindakan mendokumentasikan, menerapkan dan mempertahankan sistem manajemen keselamatan yang pada akhirnya akan diverifikasi oleh Pemerintah atau organisasi yang diakui (Recognized Organization / RO) dalam rangka penerbitan sertifikat setelah dipenuhinya semua persyaratan ISM Code.

Perusahaan (Company) yang telah memenuhi persyaratan akan diterbitkan Dokumen Kesesuaian atau Document of Compliance (DOC) dan setiap kapal yang telah memenuhi persyaratan akan diterbitkan Sertifikat Manajemen Keselamatan atau Safety Management Certificate (SMC). Baik DOC maupun SMC masa berlakunya 5 tahun. Perusahaan dan kapalnya yang tidak dapat memenuhi persyaratan ISM Code akan menghadapi kesulitan dalam kegiatan operasionalnya, baik diperairan internasional maupun domestik.

BKI sebagai Organisasi yang diakui (RO) oleh Pemerintah Indonesia, telah ditunjuk atas nama Pemerintah untuk melaksanakan approval, verifikasi dan dapat menerbitkan sertifikat DOC & SMC Interim atau short term. Sertifikat permanen akan diterbitkan oleh Pemerintah cq Ditjen Perhubungan Laut. Data perusahaan dan kapal yang telah disertifikasi akan didaftarkan dan dipublikasikan dalam Buku Register ISM Code oleh BKI.

C. Prosedur sertifikasi

Prosedur untuk mendapatkan sertifikat DOC – ISM Code sebagai berikut :

  1. Menyerahkan form aplikasi dengan dilampirkan manual Sistem Manajemen Keselamatan kepada BKI Kantor Pusat cq Divisi Statutoria atau Kantor Cabang BKI terdekat.
  2. BKI akan melakukan approval atas manual Sistem Manajemen Keselamatan. Apabila ada kekurangan, maka manual akan dikembalikan untuk diperbaiki.
  3. Apabila manual Sistem Manajemen Keselamatan telah memenuhi syarat, maka dilakukan Verifikasi Awal (Initial Verification) ke kantor perusahaan pemohon untuk diperiksa kesesuaian antara manual dengan penerapannya. Untuk ini, BKI akan mengirimkan auditor yang kompeten untuk memeriksa penerapan sistem di perusahaan.
  4. Jika memenuhi syarat, maka BKI akan menerbitkan Laporan Audit dan Sertifikat DOC sementara yang berlaku 5 bulan.
  5. Untuk penerbitan DOC permanen dari Pemerintah, BKI akan mengurus penerbitannya setelah semua ketidak-sesuaian yang ditemukan saat verifikasi sudah diperbaiki dan dilaporkan ke BKI

Prosedur untuk mendapatkan sertifikat SMC – ISM Code sebagai berikut:

  1. Kapal harus dioperasikan / dikelola oleh perusahaan yang telah memiliki sertifikat DOC.
  2. Menyerahkan form aplikasi dengan dilampirkan salinan DOC kepada BKI Kantor Pusat cq Divisi Statutoria atau Kantor Cabang BKI terdekat.
  3. BKI akan menunjuk auditor yang kompeten untuk melakukan verifikasi diatas kapal untuk diperiksa kesesuaian persyaratan ISM Code diatas kapal.
  4. Jika memenuhi syarat, maka BKI akan menerbitkan Laporan Audit dan Sertifikat SMC sementara yang berlaku 5 bulan.
  5. Untuk penerbitan SMC permanen dari Pemerintah, BKI akan mengurus penerbitannya setelah semua ketidak-sesuaian yang ditemukan saat verifikasi sudah diperbaiki dan dilaporkan ke BKI.

Setelah mendapatkan sertifikat, baik DOC atau SMC, maka ada kewajiban dari Perusahaan dan kapalnya untuk mempertahankan sertifikat tersebut dengan mengajukan permohonan verifikasi periodik kepada BKI dengan jadwal sebagai berikut:

  1. Sertifikat DOC– Verifikasi Tahunan (Annual Verification), setiap tahun dengan masa pengajuan antara 3 bulan sebelum s/d 3 bulan sesudah dari ulang tahun sertifikat.

    – Verifikasi Pembaruan (Renewal Verification), pada tahun ke 5 dengan masa pengajuan 6 bulan sebelum habisnya masa berlaku sertifikat.

  2. Sertifikat SMC

– Verifikasi Antara (Intermediate Verification), dengan masa pengajuan antara tahun ke 2 hingga tahun ke 3 dari ulang tahun sertifikat.

– Verifikasi Pembaruan (Renewal Verification), pada tahun ke 5 dengan masa pengajuan 6 bulan sebelum habisnya masa berlaku sertifikat.

BKI juga diberi otorisasi untuk menerbitkan sertifikat DOC atau SMC Interim yang ditujukan bagi perusahaan atau kapal dengan kondisi sebagai berikut:

  1. Perusahaan yang baru didirikan.
  2. Tipe Kapal baru ditambahkan pada dokumen DOC yang sudah ada.
  3. Kapal yang baru selesai dibangun.
  4. Kapal yang baru bergabung dengan perusahaan.
  5. Kapal baru berganti bendera kapal.

Persyaratan untuk mendapatkan DOC/SMC Interim adalah:

  1. Telah memiliki manual Sistem Manajemen Keselamatan sesuai persyaratan ISM Code.
  2. Memiliki jadwal implementasi selama masa berlakunya DOC / SMC Interim.
  3. Masa berlaku DOC Interim adalah 6 bulan dan sertifikat SMC Interim adalah 6 bulan (dapat diperpanjang maksimal 6 bulan lagi.)

Persyaratan untuk mendapatkan DOC/SMC Interim adalah:

  • Telah memiliki manual Sistem Manajemen Keselamatan sesuai persyaratan ISM Code.
  • Memiliki jadwal implementasi selama masa berlakunya DOC / SMC Interim.

Masa berlaku DOC Interim adalah 6 bulan dan sertifikat SMC Interim adalah 6 bulan (dapat diperpanjang maksimal 6 bulan lagi.)

D. Untuk Negara Bendera Indonesia PM 45

Sesuai dengan Peraturan Menteri Perhubungan Nomor : PM 45 Tahun 2012 tentang Manajemen Keselamatan Kapal, Pasal 3, maka jenis dan ukuran kapal yang terkena aturan ini adalah:

1. Kapal Penumpang , termasuk kapal penumpang kecepatan tinggi semua ukuran.

2. Kapal tangki minyak, kapa tangki pengangkut bahan kimia, dan kapal pengangkut gas dengan ukuran tonase kotor lebih besar atau sama dengan GT 150 (seratus lima puluh Gross Tonnage); dan

3. Kapal barang lainnya, kapal barang kecepatan tinggi, kapal pengangkut curah, kapal ikan, unit pengeboran lepas pantai yang bergerak (Mobile Offshore Drilling Unit) dan unit penampungan / produksi terapung (Floating Storage Unit and Off-loading / Floating Production Storage and Off-loading Facilities) termasuk tongkang berawak dengan ukuran tonase kotor lebih besar atau sama dengan GT 500 (lima ratus Gross Tonnage).

 

ISM Code

A. Introduction

In line with awareness about importance of human being factor and the necessity to increase vessel operational management to prevent accident to vessel, human being, cargo and property as well as to prevent sea pollution, IMO issues regulation on Ship Safety Management and sea protection, known as International Safety Management Code (ISM Code) which is also consolidated in SOLAS Convention.

B. BKI Service

According to ISM Code requirements, all companies having or operating vessel according to schedule above shall establish Safety Management System for their company and vessels to secure safe operation of vessel. Such requirement covers documenting, applying and maintaining the safety management system which finally will be verified by the Government or Recognized Organization (RO) for issue of certificate after fulfilment of all ISM Code requirements.

The Company already fulfilling requirements will be provided with Document of Compliance (DOC) and every vessel already fulfilling requirements shall be provided with Safety Management Certificate (SMC). Both DOC and SMC will be valid for 5 years. The Company and their vessels failing to fulfil ISM Code requirements will have difficulty in their operation, whether in international or domestic waters.

BKI as Organization Recognized (RO) by the Indonesian Government has been appointed on behalf of the Government to conduct approval, verification an issue DOC & SMC Interim or short time Certificate. While, permanent certificate will be issued by the Government cq Directorate General of Sea Transportation. Data on companies and their vessel already certified will be registered and publicized in ISM Code Register Book by BKI

C. Procedure of Certification
Submitting application form furnished with manual

BKI shall appoint competent auditor

to inspect conformity of ISM Code requirements on board.

If eligible, BKI will issue Audit Report and short 
term SMC Certificate valid for 5 months.
 
●
 
 For issue of permanent SMC from Government, 
BKI will arrange for the issue thereof after all 
non-conformances found upon verification have been
corrected and reported to BKI

After obtaining certificate, whether DOC or SMC, then the Company and its vessel shall maintain such certificate by submitting application for periodical verification to BKI with schedule as follows:

● DOC Certificate
– Annual Verification, annually with submission term

between 3 months before expiry through 3 months after the certificate anniversary.
– Renewal Verification, in the 5th year with submission

period 6 months before expiry of the certificate validity term.
● SMC Certificate
– Intermediate Verification, annually with submission

term between 2nd year through 3rd year of the certificate anniversary.
– Renewal Verification, in the 5th year with submission

period 6 months before expiry of the certificate validity term.

BKI is also authorized to issue Interim DOC or Interim SMC Certificate addressed to the company or ship with conditions as follows:

● Company newly established.
● Type of new Vessel is added to the existing DOC document.
● Vessel whose construction just completed.
● Vessel just joining with the company.
● Vessel just changes her flag.

Requirements to obtain Interim DOC/SMC are:

● Already having manual of Safety Management System according to ISM Code requirements.
● Having implementation schedule during validity term of Interim DOC/SMC.
● Validity term of Interim DOC shall be 12 months and not extendable, while validity term of Interim SMC certificate is 6 months (extendable maximum another 6 months).

D. For PM 45 Indonesian Flag State

According to the Regulation of the Minister of Transportation Number: PM 45 Year 2012 on Safety Management of Ships, Article 3, the type and size of vessels affected by this rule are:

1)
 
All size for Passenger ship, including High Speed Passenger ship.
 
2)
 
Oil Tanker, Chemical tanker, and Liquefied Gas Tanker with have tonnage 
greater than or equal 150 GT( One Hundred fifty Gross tonnage)
 
3)
 
Other Cargoes Vessel, High Speed Cargo ship, Bulk carrier, Fishing vessels, 
Mobile Offshore Drilling Unit (MODU) and Floating Storage Unit and
Off-loading / Floating Production Storage and Off-loading 
Facilities including Man-barge with have tonnage greater than or equal 500 GT
(Five Hundred Gross Tonnage).

Termination

You may terminate your BKI account, any associated email address and access to the BKI Services by submitting such termination request to BKI.
